MGI Tech Co., Ltd and its affiliates (collectively, “MGI Tech”, “MGI”, “We”, “Us” and “Our”), are committed to respecting and protecting your privacy. We understand the importance of processing personal data to you and strictly comply with applicable laws. The protection of privacy and personal information is one of our fundamental principles. Accordingly,  we promise to process your personal data, sell and operate the products and the applications and services provided therein in accordance with applicable data protection laws where we operate.

This Privacy Policy outlines the types of personal information MGI may collect; the means by which MGI may collect, use, or share your personal information; steps MGI takes to protect your personal information; and choices you are provided with respect to the use of your personal information.

In addition to this Privacy Policy, we provide data protection information about our products and certain features that ask to use your personal data. This product-specific information is included in our Product Handbook. Please review our Product Handbook before using our products. This Privacy Policy does not apply to any products, services, websites, or content that are offered by third parties, which are governed by their perspective privacy policies. This Privacy Policy does not address the processing of personal data of applicants or employees in the context of their employment relationship with MGI.

2. What personal data do we collect

Examples of personal data that we may collect that directly identifies you including:

a) Browser data

When you browse and use the MGI website, we may automatically collect information identifying your computer or browser, including device ID, IP address, browsing history. 

 

b) Contact information

When you submit requests or inquiries for products, and subscribe newsletter on our website, we may collect contact information about you, your business or company affiliation, such as name, function, institution or company, physical address, email address, phone number, fax number.

 

c) Intent product information

When you submit requests or inquiries for products, we may collect intent product information of you, your business or company affiliation, such as your interest product, your interest areas and your message.

4. How do we use cookies and similar technologies

We will keep you posted on our latest product announcements and upcoming promotion events with you expressly authorize and only to the extent allowed by applicable laws. And if you don’t want to be on our mailing list, you can opt-out anytime by clicking unsubscribe in the received email, which will not bring a negative impact on the relationship between you and MGI.

6. Retention/Storage period of your personal data

We retain your personal data for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. When the information is no longer necessary for these purposes, we delete it or keep it in a form that does not identify you. When determining this retention period, we take into account various criteria, including the type of services requested by or provided to you, the nature of our relationship with you, the impact on the services we provide to you if we delete some of your personal data, and retention periods required by law.

7. Sharing of your personal data

We will not sell, rent, release your personal data to anyone at any time for any purpose. We will only share your personal data in the following ways:

a) Share with MGI’ s affiliates 

We may share information with MGI’s affiliates. Your personal data may be shared within MGI’s affiliates only for explicit, and legitimate purposes, and the sharing is limited only to information required by services.

b) Share with third parties

We do not share your personal data with third parties at present, although we may disclose your personal data at the request of law enforcement agencies, regulatory agencies or other government agencies, or to meet legal requirements (such as complying with a court order). In this case, we will not provide your personal data without a valid legal document provided by the judiciary. If any changes about our sharing with third parties happen in the future, we will notify you as soon as possible and obtain your explicit consent where applicable.

8. International transfer of your personal data

Your personal data may be transferred to countries outside of the EEA. With respect to personal data coming from the EEA, we comply with applicable legal requirements providing adequate safeguards for the transfer of personal data to countries outside of the EEA. Before each transmission, we analyze the transmission scenarios and the risks they may pose before deciding whether to transmit. We ensure that the recipient of your Personal Data offers an adequate level of protection, for instance by entering into appropriate agreements and, if required, standard contractual clauses for the transfer of data as approved by the European Commission.

We use data transfer mechanisms compliant with Articles 44 - 50 of GDPR, which provide appropriate safeguards for the transfer of personal data to a third country, e.g. by

9. Rights of the data subjects

As a data subject, you have specific legal rights granted by the General Data Protection Regulation (GDPR) relating to the personal data we process about you.

a) Your right to be informed

This Privacy Policy tells you about the ways in which we use your personal data.

 

b) Your right of access

You have the right to ask us for copies of your personal information. There are some exemptions and limitations in what we can provide in response to such requests, which means you may not always receive all the personal information we process. We will inform you if any exemption or limitation applies and its impact. In addition, before exercising your right of access, we may use appropriate procedures to verify your identity as the data subject so as to meet data security requirements.

 

c) Your right of correction

In some circumstances, you have the right to ask us to correct personal data you think is inaccurate or incomplete. We will respond to your request within a reasonable period of time and inform you of the correction results or reasons why it cannot be corrected.

 

d) Your right to erasure

You have the right to ask us to erase your personal information in certain circumstances. Where it is appropriate that we comply, your request will be fully implemented within 30 days and we will inform you of the corresponding results and reasons.

 

e) Your right to restriction of processing

You have the right to ask us to restrict the processing of your personal information in certain circumstances. For example, you can request that we limit the way in which we use your personal data. In addition, when we find our data processing lacks legal bases, we will, to the best of our abilities, stop the data processing immediately and inform you and relevant parties of the result.

 

f) Your right to data portability

You have the right to receive your personal information which you have provided to us. You also have the right to have us send your personal information to another organization where our lawful basis for the processing is your consent, or where the processing is necessary for the performance of an agreement and the processing is carried out by automated means.

 

g) Your right to object

You have the right to object to the processing of your personal information in certain circumstances. Where it is appropriate that we comply with your request, we will stop processing your information for the use you have objected to.

 

h) Your right to withdraw your consent

You have the right to withdraw your previous consent in certain circumstances. This does not affect the legality of processing that is ongoing or completed on the basis of that consent until the consent is withdrew.

10. How we protect your personal data

We take reasonable and appropriate measures to protect your personal data. MGI adopts and maintains extensive technical and organizational safeguards to protect your personal data against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure or use.

However, please note that no security measures can be 100% secure and perfect, and in the unfortunate event that a personal information security incident occurs, we will report it promptly and take remedial measures in accordance with the requirements of the law and regulatory authorities.

11. Data protection for children

We do not provide products or services directly to children or knowingly collect or use any personal data from children without prior, verifiable parental consent. Children means any individuals who is under the age of 16(or the minimum legal age at which personal data is consented to be collected and processed where applicable law differs). We do not knowingly allow children to order our products, communicate with us, or use any of our website service.

 

If you become aware that a child has provided us with personal data, please contact us as indicated in Section 1 “Identity and Contact Details of the Data Controller”. We will take all reasonable measures to delete the information as soon as possible and to not use such information for any purpose, except where necessary to protect the safety of the child or others as required by law.
